By accessing or using ProfessionalCuddling.com (the "Site," "Service," or "Platform"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not access or use the Service.

ProfessionalCuddling.com reserves the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

To use ProfessionalCuddling.com, you represent and warrant that:

• You are at least 18 years of age
• You have the full power and authority to enter into this agreement
• You are not located in a country that is subject to a U.S. government embargo
• You have not been previously suspended or removed from the Service
• You will comply with all applicable laws and regulations

Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. ProfessionalCuddling.com is not liable for any loss or damage arising from your failure to protect your account.

Account Types

• Client Accounts: Users seeking cuddling services (free to use)
• Cuddler Accounts: Users offering professional cuddling services (may require subscription fees)

You agree NOT to:

• Engage in any sexual conduct, propositioning, or explicit language during or related to cuddling sessions
• Harass, abuse, threaten, or intimidate any other user
• Discriminate against any user based on race, gender, religion, disability, age, or sexual orientation
• Create fake, misleading, or impersonating profiles
• Share personal contact information (phone numbers, emails, social media handles) in public profiles
• Engage in any fraudulent, deceptive, or illegal activities
• Use the Service for commercial solicitation or spam
• Post inappropriate, offensive, or explicit content
• Attempt to manipulate the platform, reviews, or karma system
• Record or photograph any session without explicit consent

Violation of these conduct rules may result in immediate account termination without refund.

Membership Fees

Cuddlers offering professional services on our platform may be required to pay a subscription fee. Clients can browse and connect with cuddlers for free. Subscription fees are non-refundable except as required by law.

Billing

By purchasing a subscription, you authorize ProfessionalCuddling.com to charge your payment method on file. Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

Payment Processing

All payments are processed securely through third-party payment processors. ProfessionalCuddling.com does not store full payment card information on our servers.

Our Content

All content on ProfessionalCuddling.com, including text, graphics, logos, icons, images, software, and code, is the property of ProfessionalCuddling.com and is protected by copyright, trademark, and other intellectual property laws.

User Content

You retain ownership of any content you post on the Platform. By posting content, you grant ProfessionalCuddling.com a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the Service.

Prohibited Use

You may not copy, reproduce, distribute, or create derivative works of our content without express written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• We do not warrant that the Service will be uninterrupted, error-free, or secure
• We are not responsible for the conduct of any user, whether online or offline
• We do not conduct background checks on users (unless explicitly stated for verified cuddlers)
• Any cuddling arrangements are between users; ProfessionalCuddling.com is not a party to any such arrangements
• We are not liable for any injuries, damages, or losses arising from cuddling sessions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFESSIONALCUDDLING.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

ProfessionalCuddling.com may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated content
• No refunds will be provided for any prepaid subscription fees

You may terminate your account at any time by contacting support or using the account deletion feature in your settings.

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction.

You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration against ProfessionalCuddling.com.
